摘要:

2019 年全国十三届二次会议正式审议通过《外商投资法》并将在2020 年11 月1 日起施 行。该法案的颁布将建立起新外商投资的法律体系的基本框架、基本原则、指导方向，对我国新 时期新形势的要求作出了响应，为我国市场经济发展注入新的外资活力，但外商投资法带来的 机遇也伴随着问题和挑战，本文通过对外商投资法颁布的背景和外商投资法颁布后所将引发的 现象结果进行分析我国企业在其中的处境，从而为我国企业更好发展，我国市场更加繁荣提供 合理建议。

Abstract:

The Second Session of the 13th National Congress in 2019 formally deliberated and passed the Foreign Investment Law, which will come into force on November 1, 2020. The promulgation of this law will establish the basic framework, basic principles and guiding direction of the new legal system for foreign investment, respond to the requirements of the new situation in China in the new period, and inject new foreign investment vitality into the development of China's market economy. However, the op? portunities brought by the foreign investment law are accompanied by problems and challenges. This pa? per analyzes the situation of Chinese enterprises in this legal system by analyzing the background of the promulgation of the foreign investment law and the results of the phenomena caused by the promulga? tion of the foreign investment law, so as to provide reasonable suggestions for the better development of Chinese enterprises and the more prosperous market in China.
