论虚假诉讼的刑法规制-《现代农业研究》

摘要:: 近年来，在司法实践中出现了许多虚假诉讼的情况，行为人为了达到某些不正当的目的，采取捏造的虚假事实和证据向法院提起诉讼，以骗取法院的裁判文书。虚假诉讼具有极大的社会危害性，它不仅侵犯他人的合法权益，更严重的扰乱了司法秩序，长此以往，使得人们对司法公正失去信心，从而极大的损害司法公信力。为了规制日益增多的虚假诉讼，2015 年《刑法修正案（九）》中增设了虚假诉讼罪，并对该罪的犯罪构成、量刑幅度、单位犯罪以及同时构成他罪和司法工作人员触犯该罪做了明确的规定。这是我国刑法首次对虚假诉讼行为进行明确的刑法规制，使得惩处虚假诉讼行为有了确切的依据。

Abstract:: In recent years, there have been many cases of false litigation in judicial practice. In order to achieve some unfair purposes, the perpetrator has resorted to fabricated false facts and evidence to bring a lawsuit to the court in order to defraud the court's judgment documents. False litigation has great social harmfulness. It not only infringes on the legitimate rights and interests of others, but also se? riously disturbs the judicial order. In the long run, people lose confidence in judicial justice, thus great? ly impairing judicial credibility. In order to regulate the increasing number of false lawsuits, the Crimi? nal Law Amendment (9) in 2015 added the crime of false lawsuits to the Criminal Law, and made clear provisions on the constitution of the crime, the range of sentencing, the unit crime and the offence com? mitted by other offenders and judicial staff. This is the first time that the criminal law of our country clearly regulates the acts of false litigation, which provides a definite basis for punishing acts of false lit? igation.
